Prof. Beyer will discuss planning issues and strategies for clients in two intriguing situations. First, he will examine the special steps that you should take if your client’s estate contains firearms, both traditional weapons like revolvers, pistols, rifles, and shotguns as well as weapons governed by the National Firearms Act of 1934, primarily machine guns, short-barreled weapons, and silencers. Second, he will focus on the estate planning aspects of legalized marijuana covering issues such as the impact on testamentary capacity, life insurance policy applications, trust clauses concerning “illegal” drug use, and how to handle marijuana and related paraphernalia as estate assets.
